BOISE, Idaho (CBS2) — Prosecutors in the case of Lori Vallow Daybell and Chad Daybell plan to present "sufficient evidence" that shows Lori intended her two children and Tammy Daybell to die, and that she participated in the killings of her kids.
Court documents filed Thursday from Madison County Prosecuting Attorney Rob Wood and Fremont County Prosecuting Attorney Lindsey Blake.
Daybell's attorney filed a notice of alibi this month. The notice states that Daybell was in her own apartment and that her children died in her brother's apartment. The two apartments were not far apart in the same complex. Lori Daybell also says in the notice that she was in Hawaii when Tammy Daybell died. A separate motion filed by Daybell's attorney argues that Blake and Wood have not been specific enough in stating why their client is eligible for the death penalty.
In response, prosecutors say "sufficient evidence existed for the Grand Jury to find the defendant Lori Vallow intended for her children, and for Tammy Daybell to die. Further, there is sufficient evidence for a jury to conclude that the defendant participated in the killing of her own children. The facts of this case are egregious and heinous," writes Blake. "The evidence the state will introduce at trial, some of which have already been reviewed by the Grand Jury, will show that the defendant intended for her children, and her boyfriend's wife to die, and that she affirmatively acted to make those deaths happen."
CBS2 reported on January 9th, that Lori Vallow Daybell wants to be able to meet in person and via phone with her husband and co-defendant Chad Daybell.
The prosecutors have expressed "serious reservations" about Daybell's request to meet with her husband Chad, and they argue her alleged actions make her eligible for the death penalty.
